Terms of Use

1.

The present Terms and Conditions (“Terms and Conditions”) govern the use of the ALTRINEWS website, which can be accessed at www.altrinews.pt (“ALTRINEWS Site”).

ALTRI, SGPS, S.A., whose registered offices are located at Rua General Norton de Matos, no. 68, 4050-424 Porto, with a share capital of € 25,641,459.00, registered with the Porto Registrar of Companies under sole registration and corporate tax number 507 172 086, (“ALTRI”), is the exclusive and lawful owner of the ALTRINEWS Site.

By using the ALTRINEWS Site, it is presumed that User (“User”) is fully aware of these Terms and Conditions and accepts them in full and without reservation.

The User hereby expressly declares that he or she has the necessary and legally required legal capacity to accept the present Terms and Conditions in full and without reservation.

5.

The User acknowledges and expressly accepts that ALTRI may change these Terms and Conditions at any time, freely and without reservation, and any such changes shall be deemed to come into force from the date on which they are made available on the ALTRINEWS Site.

Any User who does not agree to or accept the Terms and Conditions must not proceed to use the ALTRINEWS Site. 

7.

The full content of the ALTRINEWS Site is the property of ALTRI or of the companies directly or indirectly owned by ALTRI (“ALTRI Group”), including texts, data, images, graphics, sounds, audio, video, drawings, illustrations, brands, domains, logos, photographs and all other information, functionalities and content contained therein, and is protected under the general terms of the law and by national and international legislation regarding intellectual property and copyright protection.

The ALTRI Group owns all copyrights over the contents of the ALTRINEWS Site, and copyright protection of all the contents of the ALTRINEWS Site extends to all copies and reproductions obtained or created from this content, regardless of the type, nature, form, content or means of reproduction or copy.

The User acknowledges and accepts that it is expressly forbidden to publish, reproduce, communicate, copy, disclose, transmit, distribute, use, divulge, alter, sell, publish or make available to third parties, by any means or via any medium, either directly or indirectly, in part or in full, free of charge or against payment, any of the contents of the ALTRINEWS Site, for whatever purpose, without express prior written authorisation from ALTRI.

The User acknowledges and expressly accepts that it is not permissible to use the contents of the ALTRINEWS Site for personal purposes, and it is also forbidden to alter the contents of the ALTRINEWS Site, without prejudice to the applicable mandatory legal provisions.

The User acknowledges and accepts that it is expressly forbidden to disrupt or interfere in the use of the ALTRINEWS Site, by any means or via any medium whether directly or indirectly, in part or in full, as well as not to comply with any regulation, standard or legal or administrative provision relating to or associated with the use of the ALTRINEWS Site, and it is also expressly forbidden to introduce, create or insert, add and transmit or allow access to – by any means or via any medium, whether directly or indirectly, in part or in full –  any kind of virus, bug, trojanware, script, program, system or file which results or may result in the total or partial restriction or destruction of any functionality or content of the ALTRINEWS Site.

The User acknowledges and expressly accepts that he or she is solely responsible for direct and indirect damage, including consequential damages, loss of profits and non-material damage caused to him or herself, to ALTRI, to the ALTRI Group or to any third party, arising from the use of the ALTRINEWS Site by the User. The User undertakes to pay all compensation, fines, penalties and claims which may arise from his or her use of the ALTRINEWS Site.

The User hereby acknowledges and accepts that ALTRI does not guarantee the privacy and confidentiality of any information sent or transmitted by the User via the Internet, and nor does it guarantee that the ALTRINEWS Site will operate without interruption or that it will be devoid of any errors, viruses or other malware, and further acknowledges that in such event ALTRI shall not be responsible for any damage or losses, whether direct or indirect, including consequential damages, loss of profits, and non-material damage which may arise for the User as a result thereof.

The User acknowledges and expressly accepts that access to and use of the ALTRINEWS Site are subject to failures, anomalies, disconnections, interferences and disruptions which may result from, among other things, breakdowns, overloads or other factors beyond ALTRI’s control and against its wishes, and further acknowledges that in such event ALTRI shall not be responsible for any damage or losses, whether direct or indirect, including consequential damages, loss of profits, and non-material damage which may arise for the User as a result thereof.

The User expressly accepts that ALTRI may, at any time, alter, change, add or remove any contents from the ALTRINEWS Site. 

16.

The User is solely and exclusively responsible for the use by him or herself or by any authorised third party, of the ALTRINEWS Site, and expressly undertakes to fully and without reservation comply with, fulfil and follow all applicable legislation, to wit the Code on Copyright and Related Rights, the Industrial Property Code and Cyber-Crime Law.

The User expressly acknowledges and accepts that any infringement of the Terms and Conditions may result in him or her being held legally and/or criminally liable.

18.

The User expressly acknowledges and accepts that ALTRI may, at any time, adopt and implement any measures and take any steps necessary to safeguard its legitimate rights in the event of any total or partial failure to comply, or attempted failure to comply with any of the obligations set out in these Terms and Conditions, and may suspend, limit, restrict or block the User’s access to or use of the ALTRINEWS Site, without the User being in any way entitled to indemnity or compensation.

19.

The User expressly accepts that ALTRI may, at any time and for any reason, limit, restrict, suspend or terminate access to and use of the ALTRINEWS Site, without the User being in any way entitled to indemnity or compensation. 

20.

The User expressly acknowledges and accepts that all issues not envisaged in these Terms and Conditions shall be governed by Portuguese legislation in force, and furthermore that in the event of a dispute vis-à-vis the validity, effect, interpretation, integration application of or compliance with the present Terms and Conditions, the Porto District Court shall have jurisdiction and all others shall be expressly rejected.
